After racism was defined as a crime and the Federal Supreme Court decided to equate homophobia, transphobia, and xenophobia with racism, also criminalizing these behaviors, many people have adopted the fact that “it is a crime” as the main argument to condemn these practices and have relegated to the police and the courts the role of fighting them, legitimizing institutions founded on racism, whose mission is and has always been to control and repress minorities.
